These Terms of Service (“Agreement”) constitute the contract that governs the relationship between you, and Coin Debit Co., a Delaware Corporation (“Coin Debit”) or its agents, successors and assigns. In this Agreement, “you”, “your” and similar words mean the person(s) who has received the Coin Debit Card, uses CoinDebit.io, or otherwise interacts with Coin Debit and its agents; “we”, “us”, “our” and similar words mean Coin Debit and its successors and assigns.
Please read this Agreement carefully. By using CoinDebit.io or the Coin Debit Card you agree to this Agreement, which may be periodically amended without further notice to you. This Agreement also contains important clauses, including an arbitration agreement, that governs the dispute resolution process.
The Agreement governs your use of https://CoinDebit.io (“CoinDebit.io”), your relationship with Coin Debit’s employees and contractors, and your use of Coin Debit’s gift card regardless of whether the Coin Debit Card gift card was issued virtually or physically, by mail or in person, or used for online or in-person purchases (“Coin Debit Card”).
A “physical” Coin Debit Card looks and acts like any credit card, except that you can fund it with bitcoin.
FIRST: SCAN the QR code on your Coin Debit Card
SECOND: Enter the amount that you want to load onto your Coin Debit Card. CoinDebit.io will provide an offer for the next 10 minutes.
THIRD: Send the requested amount of bitcoin to the Bitcoin or Lightning address provided.
FOURTH: Your bitcoin will be converted into a fixed dollar balance on your Coin Debit Card.
FIFTH: Write down (or take a picture of) your confirmation number.
SIXTH: Use the Coin Debit Card to purchase goods and services where Visa is accepted.
A “virtual” Coin Debit Card may be issued on CoinDebit.io. Once funded, the Coin Debit Card will appear on your screen.
FIRST: Go to CoinDebit.io and click on the option to issue a “virtual” card.
SECOND: Enter the amount that you want to load onto your Coin Debit Card. CoinDebit.io will provide an offer for the next 10 minutes.
THIRD: Send the requested amount of bitcoin to the Bitcoin or Lightning address provided.
FOURTH: Your bitcoin will be converted into a fixed dollar balance on your Coin Debit Card.
FIFTH: Write down (or take a picture of) the virtual Coin Debit Card number, expiration date, CCV security code, and billing address.
SIXTH: Use the Coin Debit Card to purchase goods and services where Visa is accepted.
Coin Debit Cards can be loaded one time only, so are non-reloadable. Coin Debit cards are not redeemable for cash, except where required by law. Coin Debit may set a maximum amount that can be loaded on any Coin Debit Card. Although Coin Debit may adjust this limit from time-to-time, the current limit is $250 per card.
Make sure to write down all of the information, including your confirmation number, credit card number, expiration date and CCV security code! Treat the card like cash. No refunds if lost.
Bitcoin loaded onto any Coin Debit Card is non-refundable. By loading a Coin Debit Card, you are purchasing a prepaid card from Coin Debit. In other words, you will no longer have any rights to the bitcoin used to fund the Coin Debit Card. Coin Debit will not hold the bitcoin for your benefit, and no special relationship--neither an agency nor fiduciary relationship--will arise as a result.
You are responsible to pay the Bitcoin miners’ fees (the Bitcoin Network’s transaction fee), and agree to set a fee that is at least 2 sats/byte. Coin Debit may require one or more “confirmations” before considering the transaction to be final. Usually, Coin Debit will consider a Bitcoin transaction to be final once it has at least 1 confirmation, as determined by Coin Debit’s reference to its bitcoin node.
Coin Debit charges a fee of $5 per month, per Coin Debit Card (“$5 Fee”). You will only be charged for Coin Debit Cards with a positive balance. The $5 Fee will be deducted from the Coin Debit Card balance automatically. Coin Debit reserves the right to adjust this fee. Coin Debit also reserves the right to charge other fees, as may be set from time-to-time. For example, Coin Debit may charge a fee for providing customer support, processing disputes, or foreign currency transactions. By using the Coin Debit Card, you represent and warrant that: (a) you are at least 18 years of age; (b) the information that you provide to us is true, correct, and complete; (c) you have read this Agreement and agree to be bound by, and comply with, its terms; (d) you will not use the Coin Debit Card for any activities that are against applicable laws; and (e) you will use the card in good faith, and not for any harmful or improper purposes.
Coin Debit accepts Bitcoin only. No exceptions. Never send anything other than BTC to CoinDebit.io, or else your fake bitcoins will be lost forever.
Coin Debit may refuse service to anyone, which may involve limiting access to CoinDebit.io. Coin Debit may limit the type, amount, or number of transactions you can make with your Coin Debit Card. We reserve the right to block, suspend, or cancel your Card Account or Virtual Account if we detect what we reasonably believe to be activity that is inconsistent with this Agreement. If Coin Debit exercises any of its rights, we will incur no liability to you because of any resulting unavailability of the funds, or inability to use, your Coin Debit Card. The Coin Debit Card will remain the property of Coin Debit and must be immediately returned upon request.
Each time you use your Coin Debit Card, you authorize us to reduce the value available in your Coin Debit Card by the amount of the transaction and any applicable fees. You agree that Coin Debit will not be liable for any unsuccessful Coin Debit Card transactions. You may not exceed the available amount in your Coin Debit Card through an individual transaction or a series of transactions. Any transaction that exceeds the amount available, in the reasonable discretion of Coin Debit, will be declined.
You may not use your Coin Debit Card number in connection with the creation and/or negotiation of any financial transactions, such as financial instruments, which Coin Debit has not expressly authorized in writing. The Coin Debit Card cannot be redeemed, whether for cash, bitcoin, or at an ATM. You may not use your Card or Virtual Account for illegal online gambling or any other illegal transaction.
To check your card balance, either scan your physical card’s QR code, or go to CoinDebit.io to check your balance. Merchants generally will not be able to determine your available balance. It’s important to know your available balance before making any transaction.
Coin Debit is not liable for acts and omissions that constitute ordinary negligence. Coin Debit will not be liable for losses that could have been avoided by proper use of its Coin Debit Card, including writing and saving all information provided to you upon funding of a Coin Debit Card. Coin Debit is not responsible if you misplace or lose your Coin Debit Card.
The bitcoin used to purchase an unsecured liability from Coin Debit will belong to Coin Debit, and in return, Coin Debit promises to pay no more than a fixed dollar amount to third-party merchants upon your request and at your discretion. Coin Debit’s liability to you, in any event, shall be limited to the value of your property, in dollars, valued at the time you send it to Coin Debit.
You and Coin Debit both agree to maintain as confidential, and hold in confidence, information relating to our relationship, except for the following: when appropriate to facilitate transactions or operate Coin Debit’s business; in order to comply with government agency or court orders or other legal reporting requirements; when you give us your written permission; to our employees, auditors, affiliates, service providers, or attorneys, as needed; or as otherwise necessary to carry out the intent of this Agreement.
Any term or provision of this Agreement that is invalid or unenforceable in any situation in any jurisdiction shall not affect the validity or enforceability of the remaining terms and provisions hereof or the validity or enforceability of the offending term or provision in any other situation or in any other jurisdiction.
This Agreement, its enforcement and the performance of the parties hereunder, and all suits and special proceedings that may ensue from its breach, shall be construed in accordance with and under the laws of the State of California, without regard to its conflict of laws principles. The parties agree that if for any reason the arbitration provisions hereof are found to be unenforceable, any action with respect to or arising out of this Agreement shall be brought and maintained in a state or federal court of competent jurisdiction located in Los Angeles County, California. The parties irrevocably consent to the personal jurisdiction of California’s Superior Court.
Upon the election of Coin Debit, any dispute arising out of or relating to this Agreement, its enforcement or interpretation, or arising out of an alleged breach, default, or misrepresentation in connection with any of its provisions, or arising out of or relating in any way to the Agreement, shall be settled by final and binding arbitration in Los Angeles, California (or such other place as may be agreed to by the parties) before a panel consisting of one (1) arbitrator, selected in accordance with the Streamlined Arbitration Rules and Procedures of JAMS. The award rendered by the arbitrator shall be conclusive and binding upon the parties hereto. Each party shall pay its own attorneys’ fees and expenses of arbitration and the expenses of the arbitrators (including their compensation) shall be borne equally by the parties. This arbitration clause shall be governed and interpreted pursuant to the Federal Arbitration Act.
Notwithstanding the foregoing, it shall be a requirement that before any party institutes an arbitration in accordance with the foregoing, that party must provide a written notice of the dispute to the opposing party, specifying with reasonable particularity their dispute. The parties shall then mutually agree upon a mediator and shall convene a full-day, in-person mediation, involving all decision makers for the various parties, in an effort to resolve any disputes. Should the parties fail to agree on a mediator, then they shall submit a request for JAMS to do so on their behalf. The mediation shall be administered by JAMS, or another service or mediator mutually acceptable to the parties, and shall occur in Los Angeles, California. Only after satisfying this requirement shall any party have the right to institute an arbitration proceeding.
In any action, proceeding, investigation, or alternative dispute resolution arising from or relating to CoinDebit.io, or from your access, use, or interaction with a Coin Debit Card, each party shall bear their own costs and attorney fees.
Unauthorized use of CoinDebit.io, including, but not limited to unauthorized entry into our systems, misuse of passwords or misuse of any other information, is strictly prohibited. You may not use CoinDebit.io in any manner that could damage, disable, overburden, or impair any CoinDebit.io or service of CoinDebit.io or interfere with any other party’s use and enjoyment of any CoinDebit.io or service of CoinDebit.io. You may not attempt to gain unauthorized access to any CoinDebit.io CoinDebit.io, service, computer systems, or networks connected to any CoinDebit.io or service of CoinDebit.io, through hacking, password mining, or any other means. You agree that you will not engage in any activities related to CoinDebit.io that are contrary to applicable laws or regulations.
We do not guarantee uninterrupted access to CoinDebit.io, or that CoinDebit.io cannot be tampered with by third parties. While we have implemented security measures designed to protect most information sent to CoinDebit.io, we do not guarantee that information sent to CoinDebit.io will not be obtained, reviewed, disclosed, or tampered with by third parties.
We reserve the right, in our sole discretion, without any obligation and without any notice requirement, to change, improve, or correct the information, materials, and descriptions on this CoinDebit.io and to suspend and/or deny access to this CoinDebit.io for scheduled or unscheduled maintenance, upgrades, improvements, or corrections. The information and materials on this CoinDebit.io may contain typographical errors or inaccuracies. Any dated information is published as of its date only, and we do not undertake any obligation or responsibility to update or amend any such information. We may discontinue or change any product or service described in or offered on this CoinDebit.io at any time.
From time to time, links may be established between CoinDebit.io and websites operated by, or content provided from third parties. For purposes of these Terms, the term “link” includes both hypertext links to external websites or content, and hypertext links that draw material from other sources into CoinDebit.io. Except to the extent we expressly state otherwise, we have no control over any third-party websites. In addition, from time to time, products and services provided by third parties may be offered for sale or made available through links from this CoinDebit.io: any such offer does not constitute an endorsement by us of the products or services or the providers. In no event will we have any liability related to any third-party webCoinDebit.io, products, or services.
Although we attempt to provide useful information, we do not guarantee the information posted on or linked to CoinDebit.io is accurate, current, or suitable for any particular purpose. We assume no obligation to update or continue to post or link to the information.
CoinDebit.io, any posted or linked information, and any related software are provided on an “as-is” basis, with no warranties of any kind whatsoever, either express or implied, including, but not limited to any warranties of title or accuracy, or any implied warranties of merchantability or fitness for a particular purpose. Use of CoinDebit.io, and any associated information and software, is at your sole risk.
Neither we, nor any third party involved in the creation, production, or delivery of the information at this CoinDebit.io, nor the officers, directors, employees, or representatives of the foregoing, will be liable in any way for any direct, special, punitive, consequential, or indirect damages (including without limitation, lost profits, cost of procuring substitute service, or lost opportunity) arising out of or in connection with this CoinDebit.io, or use of this CoinDebit.io or a linked CoinDebit.io, whether or not we are made aware of the possibility of such damages. This limitation includes but is not limited to the transmission of any viruses, data, or harmful code that may affect your equipment; any incompatibility between CoinDebit.io’s files and your browser or other program used to access CoinDebit.io; any failure of any electronic or telephone equipment, communication, or connection lines; unauthorized access; theft; operator errors; or force majeure. We do not guarantee continuous, uninterrupted, or secure access to CoinDebit.io or a linked CoinDebit.io. We do not always investigate, verify, monitor, or endorse the content, accuracy, opinions expressed, and links provided by the operators of a linked CoinDebit.io.
The headings of this Agreement are provided for convenience only, and neither limit nor modify the content of each sections following the heading.
